The marriage equality debate under the provisions of the Special Marriage Act (SMA) has been an ongoing hearing in the Supreme Court of India by a five-judge bench led by CJI D Y Chandrachud since 18 April 2023. This is a crucial moment for the queer and trans community who are looking forward to the realization of many civil rights where recognition of partnership through marriage is one of them. Marriage is the central pillar to which most of our economic privileges and access to resources are attached to. Within this lurks the issue of legal inheritance, sustainable care networks,  housing, health care, social security and many others. Through our collective community engagement we have witnessed familial violence as a critical point of intervention during a crisis. It remains largely unaddressed within the legal parameters available to the citizens. From this emanates the notion of a chosen family beyond the aegis of blood and marriage, that will be part of the discussion as well.
